Rufunsa man gets 40 yrs for defiling girl

LUSAKA High Court judge Conceptor Zulu  has sentenced a 50-year-old man of Rufunsa district to 40 years imprisonment with hard labour for defilement. Before judge Zulu was Lupiah Sakala who was convicted of defiling a 10-year-old from Shapola village in Rufunsa district in November last year.

The Subordinate Court found Sakala guilty of having carnal knowledge of the victim on September 8, 2017 and was committed to the High Court for sentencing. According to evidence on record, Sakala on the material day was molding bricks in Shapola village when he found the girl drawing water alone.

Sakala took the girl in the bush where he undressed her and himself before doing ‘bad manners’ on her. The court heard that the girl knew Sakala very well but that on the fateful day, he covered her mouth and defiled her. The victim went back home while crying and reported what Sakala did to her before he was dragged to the police.

In finding him guilty, the court said it did not find any reason why the child could deliberately and dishonestly make a false allegation against Sakala whom she knew very well as they stayed in the same village. The court had stated that the victim was an exceptionally intelligent child whose ability of observation and recalling could not be doubted and convicted Sakala.

In mitigation, he asked for leniency, saying he was a first offender and remorseful over his actions. He also said he was married with two children. But judge Zulu said she considered his mitigation and sentenced him to 40 years due to the seriousness of the offence he committed.
