LUSAKA High Court judge Conceptor Zulu has recused herself from handling the case in which PF secretary general Davies Mwila sued Roan PF member of parliament Chishimba Kambwili for defamation of character.
In a statement of claim filed in the principal registry in December, Mwila is claiming damages for libel arising from words which Kambwili uttered at a press briefing on October 27 which was covered and published by various print and electronic media houses with both local and global reach.
Mwila is also seeking punitive and exemplary damages and interest on the damages at the current commercial bank lending rate.
He has complained about Kambwili’s statement in which he alleged that the former was dull and only obtained a grade 12 certificate after a young boy wrote the examination on his behalf.
The case was allocated to judge Zulu on December 17 last year.
But according to a memorandum addressed to the judge-in-charge, judge Zulu has stated that she personally worked with Kambwili during her tenure of office as administrator general and official receiver.
“The administrator general and official receiver was in charge of RAMCOZ, a company whose assets are situated in Luanshya, the parliamentary constituency of the defendant,” said judge Zulu.
