THE Chipata Magistrates’ Court on Thursday sentenced a former accountant at the Ministry of Health in Chipata district to two years imprisonment for theft.
Before Chipata magistrate Pauline Mulenga was Fred Halwiindi of Kanjala Drive area who stood charged with 18 counts of theft by public servant, one count of being in possession of property suspected to be proceeds of crime and one count of forgery contrary to the laws of Zambia.
The state called 17 witnesses to prove its case while Halwiindi, 37 testified on oath in defence after being found with a case to answer but did not call any witness.
In passing judgment, magistrate Mulenga said the state had proved the case beyond any reasonable doubt in all the counts and convicted Halwiindi accordingly.
In mitigation, Halwiindi said he was a first offender who was also married and has a child who depends on him.
Halwiindi asked the court to exercise leniency on him as he was a law abiding citizen who had never committed any offence in the past.
In passing sentence, magistrate Mulenga said she heard what the convict said in mitigation and that he deserved some leniency.
She however, said offences of such nature were common among public workers in the country.
Magistrate Mulenga then sentenced Halwiindi to two years imprisonment with hard labour effective yesterday in each count and the sentences will run concurrently.
