MMD deputy spokesperson Peter Phiri has urged Felix Mutati to surrender in his fight for the former ruling party’s presidency before more embarrassment is inflicted on his already finished political career. Speaking after High Court judge Sharon Newa dismissed Mutati’s applications to subpoena Nevers Mumba’s lawyer to aid their defence in a case, Phiri said Mutati had suffered a huge defeat in his desperate attempt to hold on to his illegalities regarding the MMD presidency.
In this matter, acting MMD national secretary Winnie Zaloumis challenged the legality of the convention which saw the election of Mutati, Mwansa Mbulakulima, Raphael Nakacinda and George Kangwa as new leaders of MMD in 2016. When the matter came up for commencement of defence before judge Newa early this year, lawyers representing Mutati told the court that they were ready to begin their defence but they had two applications to make.
Jonas Zimba said his clients wanted to subpoena Madaika to stand as a witness in their defence and they also wished to amend their defence by adding a counter claim. But Mumba’s lawyers Mulambo Haimbe objected to the application saying the matter was scheduled for opening of defence and that Mr Mutati and the others had 500 witnesses to testify in their defence and therefore the court should not waste time on the two applications.
Judge Newa yesterday delivered her ruling throwing out Mutati’s application with costs.
She further ruled that Mutati and his team should take the stand on June 7, 2019.
Phiri said Mutati’s day of final reckon was very close. He said Mutati brought up the two applications as a delaying tactic.
He said Mutati’s tricks to cling to the leadership of the MMD had failed to work.
“As the MMD, we welcome this ruling with both hands. This ruling has exposed Mr. Mutati to the effect that he has no answers to our question of who gave him the authority to organise the illegal convention of 2016. His tricks to avoid answering those questions have been clipped and he now will have to answer us on the 7th of June 2019,” Phiri said.
Phiri further said Mutati had continued paying for his sins.
“The Judge in her landmark ruling awarded us legal costs. And this is not the first time we have been awarded costs. Mutati and his team owe Dr Nevers Mumba’s lawyers over K4m in legal fees once everything is quantified by our lawyers,” Phiri claimed.
“The Mutati illegal faction has been playing tricks and maneouvres for the last two and half years. They have been losing miserably on all claims brought to all the courts of law from the High Court through to the Supreme Court and the Constitutional Court. This has been a clear abuse of the court process by people who aspire to one day rule this country.”
