Complainant applies to withdraw theft case against lawyer Mutemwa

THE pain of seeing his lawyer prosecuted for heist involving US$800,000 after a mix-up has forced Lusaka businessman Lishandu Chinjenge to withdraw the complaint against state Counsel Mutemwa Mutemwa, his son who goes by the similar names and police officer Dennis Mano.

Mutemwa and his son who are both lawyers, on October 19, 2021 jointly and while acting together allegedly stole US$800,000 belonging to Chinjenge.

Mano, a detective inspector at Force Headquarters who is facing a charge of theft by servant, is alleged to have stolen the said amount which came into his possession by virtue of his employment.

When the matter came up for commencement of trial before Lusaka chief resident magistrate Dominic Makalicha, State advocate Mukuma Chipawa informed the court that Chinjenge wished to address the court.

Chinjenge told magistrate Makalicha that the criminal charges against Mutemwa had shaken their lawyer, client relationship, therefore he had decided not to have him face the wrath of the law.

“After a deep reflection, I have decided to withdraw my complaint against the accused on reasons that State Counsel Mutemwa is my lawyer and the court proceedings are prejudicing client, lawyer relationship. He is supposed to advise me on this matter but this will not happen because of this case. I still have ongoing transactions with him and I don’t wish to change lawyers,” said Chinjenge. “I thought by complaining there would be no effect or prosecution but instead an opportunity for the parties to meet. It is against my Christian and traditional values and adviCe from my father that I continue with these court proceedings. This is injuring my conscious.”

Following the explanation by Chijenge, Chipawa made an application to have the matter discontinued.

“In the premise we wish to discontinue this matter in line with section 201 of the CPC (Criminal Procedure Code),” said Chipawa.

Magistrate Makalicha reserved ruling for December 8, 2021.
